Judge Charles Henry granted District Attorney Ernie Lee’s request for a November 8th trial date for Earl Kimrey.
Kimrey is accused of killing 3-year-old Mariah Woods in 2017.
Kimrey’s defense attorney, Wally Paramore, requested a 2022 trial date.
Paramore raised concerns about witnesses being available close to the holidays.
Lee expects that the defense will attempt to continue the case and that the trial could still be pushed to 2022.
Woods disappeared from her Onslow County home in 2017 and her body was later found in a creek in Pender County.
An autopsy revealed Woods died from chloroform toxicity.
Kimrey was the live-in boyfriend of the toddler’s mother at the time.
